Here’s What You Need to Know About Underage DUI on Prom Night

Prom is an exciting time for the younger folks. It’s a rite of passage where teenagers get the chance to dress up and shine like a star. It’s not just a glamorous party; prom marks an end of an age as well as a new beginning of another chapter in a young person’s life.

Unfortunately car accidents are quite common on prom night. While it’s an exciting time to be in, drinking and driving usually accompany this special occasion. As a result, many get seriously injured or, worse, die.

Understandably the youngsters tend to be adventurous, willing to explore anything new, even the dangerous stuff. But to make prom night a pleasant and positive experience for them to cherish for the rest of their lives, it is crucial to eliminate drinking then driving.

It’s not just the teenagers that need to understand this. Parents too need to play a critical role in elucidating the very serious risks of underage alcohol drinking and driving on this momentous night.

Facts about Underage Drinking and Driving

By law, teens are prohibited from purchasing and/or consuming alcoholic or intoxicating beverages. In the State of Nevada, there is strict enforcement of this rule.

Perhaps it’s pop culture or what-not, but unfortunately many teens associate prom nights with alcohol consumption. According to statistics, around 6 percent of U.S. students surveyed by concerned citizens’ group and an insurance company have operated a motor vehicle while under the influence of alcohol on their prom.

The same group of surveyed students revealed that nine out of ten of them believe their classmates have a strong predilection to drink and drive on that special night.

While 6 percent may seem like a little figure, that number is dangerous high, considering the likely consequences of underage driving while drunk. In many cases, there are serious injuries and deaths that occur on the occasion of teen DUI (driving under the influence) cases.

According to the U.S. Centers for Disease Control and Prevention, around 85 percent of teens who figured in a car accident resulting from drunk driving admitted to binge drinking. Having at least five drinks in a short period may be considered binge drinking.

Also, about 80 percent of teenagers registered a BAC (blood alcohol concentration) level of more than 0.08 percent, which is the limit set by law. Male teenagers are more likely to drive while drunk.

Preventing Teenage DUI

Whether it’s prom night or just an ordinary weekend, preventing teenage DUI is imperative. There have been countless lives lost or irreparably changed as a result of drunk-driving car collisions.

To address the widespread occurrence, intense clampdown was initiated by various law enforcement agencies of each state. Zero-tolerance policies were enforced against teenagers caught drinking alcoholic substances then driving.

Alcohol drinking by persons under the age of 21, in itself, is already prohibited. Thus, a higher penalty is imposed against persons committing underage drinking and driving. In addition, subsequent convictions for the same offense will result in steeper punishment.

Recognizing the Serious Safety Risks of Underage DUI

For parents and guardians, it is important to impose strict discipline against underage drinking and driving. If ever these minors drink, encourage them to open up and call for a ride home instead of risking life or limb.

Remember the life you save may not just be that of your child but also of other drivers who share the road.

Workers’ Rights and Employers’ Responsibility for a Safe Christmas Work Party

The lights are up, and the tree decor looks gorgeous. It’s that time of the year when the world falls in love, as the song goes. Regardless of your personal beliefs, traditions, or preferences, Christmas remains one of the happiest times of the year for many people.

When this joyous occasions comes, there is a good chance your boss will invite everyone to an office-sponsored party.

But did you know Christmas parties carry a potential risk of injuries for those that attend it? Sure it can be a fun and socially engaging event. Most people wouldn’t think they would suffer injuries at such a joyous celebration. But the possibility is there.

Here are some of the common causes of accidents and injuries during a typical Christmas work party.

Slipping on a wet floor

The usual fare of drinks and food at a Christmas party can cause potential disaster. When stepped on, one can slip and fall. It’s even more unfortunate if that person drags another one as he or she falls to the floor.

Whether it’s ice, soda, beer, or wine, these beverages when spilled on the floor can set a dangerous condition for an event attended by inebriated individuals. Where dancing goes wild and people tend to be careless, it’s an accident waiting to happen.

Food Poisoning

Another usual cause for injuries at a Christmas party is food poisoning. It may result when the food has actually gone bad or when something went wrong during its preparation or with its ingredients.

Food poisoning is a potentially dangerous condition; sometimes requiring medical attention. While it can be rarely fatal, it can cause extreme pain or discomfort.

Alcohol Intoxication

We all know where it leads to; drinking too much can lead to loss of coordination. This can be very dangerous if the person decides to drive his or her car home even under this state.

Loss of coordination can also lead to bumbling and clumsiness. With an object in the way, an intoxicated person may hit it, dropping the item onto another person and cause injury.

What to Do If You’re Injured at a Christmas Party at the Office?

So you attended your company’s Christmas party, and unfortunately you fell on the floor and suffered an injury. What are you going to do next?

First off, you’re probably wondering if your workers’ compensation benefits would cover your injury. Second, you’re probably thinking if filing a legal action against your employer would be a good thing. Lastly, will this expose you to retaliation from your boss should you decide to take legal action for your injuries?

These are some of the good questions to refer with an attorney who specializes in personal injury and workers’ compensation matters.

Filing a Claim for Compensation

You’ll be glad to know you can apply for workers’ compensation benefits for injuries suffered during an office Christmas party. The grant, however, thereof is on a case-to-case basis. There may be several factors to consider.

If you believe you have a claim for compensation on account of your injuries, you need to file it soon. Get in touch with our Las Vegas workers’ compensation attorney to help you pursue your legal action.

Top Tips to Stay Safe during the Holiday Season

What better way to enjoy the holiday season than spending it with family and friends. Gathering around the table, feasting on the food while reconnecting with loved ones. It can a joyous occasion.

But the hustle and bustle of this time of the year can get the best of us. If not wrapping gifts, most of us go on a holiday rush, buying gifts and hope to get all we need in time.

What is often overlooked during this hurly-burly time and commotion is the risk for injuries. While it may be the farthest thing that comes to mind as many of us are happily frazzled, accidents can happen.

From cooking mishaps to rough holiday crowds, people can get injured. But shouldn’t the holidays be spent with family and friends and not at the hospital?

For a safe and enjoyable holiday season, we offer these simple tips. We wish you a happy and injury-free celebration for you and your family.

Be Careful with Candles and Fireplaces

Reduce the risk of fire-related accidents or injuries by observing these guidelines. Don’t forget to blow out candles and fireplaces before heading to sleep or going out. Never leave candles near curtains, drapes, or other items that easily ignite. Also, keep the flames away from the children’s reach. If left unattended, lit candles have the risk of causing a tragic fire accident.

Think of the Kids When Decorating or Gift-Giving

Younger children are curious and have the tendency to put objects in their mouth. When giving gifts, choose age-appropriate toys that have no small or toxic parts. As for the indoor decoration, keep potentially dangerous items away from children’s reach.

Traveling Safely with Family and Friends

Some people prefer to spend the holidays traveling from place to place. Whether it’s by foot, car, or plane, always make safety a priority.

When driving in snow or icy conditions, exercise caution by slowing down while paying attention to all elements. Make sure to get your vehicle equipped with suitable windshield wipers and tires.

Never drive distracted or fatigued. Always put away the phone down and concentrate on the task at hand. Make sure you are well-rested when operating a motor vehicle.

Moderate Drinking and Responsible Driving

Alcohol is always a staple in most holiday events. Which is why careful consideration should be made with regards to its consumption.

Driving while under the influence or intoxicated is a recipe for disaster. If you had too much to drink, get a cab. Or you can ride with a designated driver.

Kitchen Safety

Spills and mess may be a common thing, but it’s the last thing you should be worried about when in the kitchen. There are other serious concerns such as burn injuries, slips and falls, cuts, and fire.

For the fire risk issue, always turn off the oven and burners before going to sleep or heading out.

The risk of cuts and knife accidents is minimized when you get the right blades for the job. Of course, it pays to be extra careful when handling these sharp objects.

Children are curious creatures. So it’s best to keep the hot, burning, or sharp objects away from their reach to avoid injuries or accidents. Also, minimize the risk of slips and falls by cleaning up spills as they happen.

Stay safe and injury-free during this joyous season. A friendly greeting from Dan Lovell of Empire Law Group.

What to Do If the Car Accident Was Your Fault?

Imagine cruising through the highway at moderate speed. Approaching the intersection, you took your eyes off the road for a couple of seconds to adjust the volume of the radio. But those few seconds are all it took for the traffic light to change.

Because you didn’t notice the car in front of you slowed down, your car crashed into it. Whichever way you look at it, this accident was your fault. So what do you do now?

In our series of articles, we always featured scenarios where you are the party who sustained injuries or incurred damages as a result of car accidents. But what if you are the erring driver? Are you wondering what to do if the car accident was your fault? Let’s explore this context.

Getting into a car crash is scary enough by itself. But when the accident was your fault, it’s all the more stressful. You tend to feel even worse because you will likely shoulder the repair costs and other expenses for your vehicle and of the car you bumped.

When you get in a car accident, there are a few things you should do. Similarly, there are things you should never do. In this article, we will focus on those things.

What to Do

Accidents can happen, especially in fast-moving roadways where a quick moment of distraction may lead to catastrophic consequences. When it was you through your fault or negligence that set off the car accident, here are important steps to consider. These simple guidelines seek to protect your rights while saving you from hassle down the road.

Call the police. In all car accidents, whether minor or high-speed, you will need to call law enforcement officers. The reason behind this, among many others, is that you need a police report in support of your claim for compensation for damages with your insurance provider.

Check for injuries. It could be a scratch, bruise, muscle strain, or sprain. Injuries are not uncommon in car accidents. So make sure to check your person for injuries. Same goes with other people in the car. See if they suffered minor or major injuries. Call an ambulance if you’re not sure as to the severity of their injuries.

Exchange contact and insurance information with other drivers. Make sure you request for these bits of information of the other drivers. Obtain their phone number, email, and insurance information whenever possible.

Take photos. Make sure to get photos of the scene of accident as well as the damage incurred by all vehicles involved. These images will come in handy when you need to file an insurance claim, among other things.

Call your insurance provider. Notify your insurance provider about the car accident.

Never Do These Things

Don’t let your emotions get the best of you. In a stressful situation such as a car accident, emotions tend to run high. Avoid getting mad or causing a scene by yelling or otherwise. Stay calm and relaxed. It can help you think better.

Never admit fault. Even if you believe it was entirely your fault, never say it was you who caused the car accident. This admission may be exploited by the other drivers, creating more liability for you.

Don’t apologize just yet. While it’s good to express regret over something you believe was your wrongdoing, don’t apologize just yet. Your apology might be construed as an admission of fault or negligence.

Never discuss the details of the accident. As a rule, only speak with the police, your insurance provider, or lawyer about the details of the accident.

Never leave the scene first. Make sure the police have investigated and made a report about the accident before leaving the scene.

In case of doubt, speak with a highly experienced car accident attorney to ensure that your rights and interests are protected.

Reporting a Car Accident to the Police

In minor car collisions, they’re ideally no-fuss. After the accident, there will be a quick exchange of contact numbers, insurance information, and other key details, and then that’s it. Drivers involved in the accident will let their respective insurance providers handle these matters. How convenient, don’t you think? So you might wonder, is there a need to call the police?

Actually, yes, parties involved in a car accident may still need to contact law enforcement officers. No matter how minor the accident was, you’ll still need to secure a police report on the collision. Truth be told, reporting the matter to the police will save you from the hassle later on.

While reporting to the police is imperative, what’s optional is informing the insurance provider. Parties to the accident may dispense with the intervention of the insurance companies. For instance, they may opt to have their respective damage repaired out of their own pockets.

The Importance of Securing a Police Report

A police report covers the circumstances surrounding the accident. With this document, it negates the likelihood of creating assumptions as to what happened. Thus, in the event of a legal action for recovery of damages, it effectively eliminates disputes on the turn of events.

It becomes easier to seek compensation because the police report can strengthen the case. Whether the car accident is a major or minor one, it is best to secure this piece of paper.

This unbiased account of the accident contains the following information:

Names of the parties involved,

Injuries sustained by the parties, if any,

Damage to the vehicles involved,

Time, date and place of the accident, and

Statements of witnesses.

Here are tips when reporting a car accident to police officers.

Call 911 Immediately

If you’re involved or witnessed a car accident (especially a major, catastrophic one), the first thing you need to do is call 911. Do this even if there are no apparent injuries or damage. The purpose is to let the police officers ascertain the circumstances and write a report on the incident.

There will be an investigation as soon as the police officers will arrive. Searching questions will likely focus on who or what caused the accident and how.

Law enforcement officers will also want to obtain the personal and contact information of the involved drivers and passengers, if any. The police, however, will focus more on the driver; whether there was a likelihood that he or she drove under the influence.

Witness on the scene as well as injured bystanders will also be requested to give their personal and contact information. Statements will also be obtained.

Based on the investigation, the police officers responding at the scene will make the report.

What If There Are No Police Officers at the Scene

There may be instances when police officers don’t respond at the scene of the accident. Thus, you may need to file your own report to the police as soon as possible. In support of your narrative, taking photos and/or videos that cover all angles is highly recommended.

Collect as much evidence as may be available and necessary in support of your side of the story. This may be needed as it is not uncommon for the party at fault to change their story to evade liability.

Contact an Experienced Car Accident Attorney

To cover your bases, seek legal representation from an experienced car accident lawyer. With his or her help, you can ensure that your interests and rights are protected during your action to obtain compensation for damages.

Tips for Taking Photos Following a Car Accident

The events following a car accident can be very crucial. What you do afterwards can make or break your case should you decide to pursue a legal action in court.

While your primary concern after a car accident should be your safety and well-being, the next logical priority are your legal rights. If you have been wronged, it is only just that you receive some form of recompense for the loss or harm you suffered.

But in most cases, recovery of damages can become a lengthy and protracted legal battle. Without evidence in support of your cause of action, your lawsuit will be pointless, incapable of producing the desired outcome.

Which is why, writing down notes following a car accident is a proven useful device in preserving in your mind as much details of the unfortunate event. In support of your written accounts are photos.

What better way to show the extent of the damage to the court or the insurance provider than using pictures. Visual images can eliminate any doubt as to your claim of damages sustained. Thus, should the matter proceed in a legal battle, it’s a lot easier to demonstrate the harm done by the erring driver.

In this article, we offer pointers on how to effectively take photos at the scene of the car accident.

Preserving the Evidence

Photos are very effective minimizing disputes on facts relating to the scene of the accident. By taking images, you preserve the evidence, which is crucial in support of your legal claims. Even a quick glance of the photos can give its viewers a depiction of what happened. In turn, these images can give an impression of who was at fault and what is the extent of the damage.

Taking Effective Pictures

Photos are pieces of evidence, which may be given greater weight in legal disputes involving car accidents. Thus, it is critical that you take quality photos of the scene of the accident. Make sure the images reflect proper context and accurate details. Get pictures from every angle possible, highlighting the damaged areas.

General View of the Scene of the Car Accident

First off, take pictures that depict a general view of the accident. Without going into the details, obtain multiple shots from various angles. Begin by including all the vehicles directly in contact with your car. Then take a snapshot of each of those vehicles along with your vehicle.

When shooting a photo of these cars, make sure you get all the involved vehicles in the frame relative to the position of your car. Take pictures from various angles to demonstrate each car’s proximity to other cars involved.

Traffic Lights, Road Signs, and Weather Conditions

If the accident occurred near a traffic light or road signs, take photos of these fixtures in relation to the vehicles. Should there be any signs, posts, guardrails, or similar stationary objects that were damaged on the occasion of the car accident, you should get photos of them too.

Weather conditions can also play a factor in car accidents. So if rain or snow contributed to the unfortunate occurrence, it’s best to take photos of the state of the atmosphere at that time.

If there are any, get shots of skid marks, roadside debris, and other signs of the accidents within the immediate vicinity.

Detailed Images of the Damage, License Plates, Etc.

Get close-up shots of the scratches, dents, and broken glasses of the vehicles. Whenever permitted, take photos of the interior as well, if there are anything damaged.

For proper identification of the vehicles, take snapshots of their license plates as well as the insurance cards of the other drivers.

Injuries

Photos of your injuries are the among the best proof of what you sustained as a result of the car accident. However, as a matter of propriety and civility, please refrain from taking photos of the injured people, unless they themselves permitted you to do so. Be respectful of other people’s privacy.

Seek Legal Representation

If you’re looking to explore your legal options, contact a car accident attorney.

Safe Boating Tips This Summer

The sun’s out and the weather’s warm. What a perfect time to go boating. Summer is the ideal season to take the family and friends and hop on a boat and get on the water. Whether you’re regularly taking a boat trip or just on specific occasions, it is important to always keep safety in mind.

For boat owners or operators, make sure that the vessel is in seaworthy condition. The boat also needs to have sufficient provisions while the crew must be competent and well-trained to take the boat onto the sea. Failure to observe the requisite degree of diligence on their part can lead to liability for damages in favor of the injured persons.

Passengers, on the other hand, should follow the rules as they pertain to their safety. Any contributory negligence on their part may negate or diminish any liability on the part of the boat owner or operator.

But ultimately, your safety is your responsibility. Be alert for potential accidents, and always be mindful of any catastrophe that may arise in the seas. Here are simple boating safety tips to observe when you, your family, or your friends are out on the water.

Don’t Drink and Boat

Just like driving automobiles, alcohol and boating don’t mix well. If you want to partake in the festivities with these beverages, make sure you have another person who will operate the vessel. Operating the boat while intoxicated can just be a dangerous as drunk-driving.

Check the Weather

Before heading to the open water, always check the weather reports. Know what’s brewing and what to expect when you head out there. A seemingly bright, sunny weather can turn into a storm out of nowhere. Should you notice a formation of dark clouds or a drop in temperature, get back to the docks.

Make Sure You Have Proper Boating Equipment

Know what tools and equipment are essential for every boating trip, and make sure you have them for the trip. First off, there should be ample number of life jackets for the crew and passengers on board. Lift rafts, emergency lights, and extra batteries should be available too. Other essentials include cellphones and other communication devices, flares, and first-aid kits.

Let Others Know You’re Going Out to Sea

This is important. If anything bad should happen, the informed person can always contact the authorities for help. What’s crucial is that there is someone who may suspect of the happening of an unfortunate event then seek assistance.

Learn to Swim

Should the boat capsize or sink, swimming becomes a critical skill that can save your life as well as others. Of course, it helps to have a life jacket to help you keep afloat when you’re already in the water for hours and tired.

Take a Course in Boating Safety

Some jurisdictions require boat owners or operators to undergo basic boating education or training courses before they can take their vessel off to sea. This is not just a regulatory matter; compliance with the rule may save a life or two while you’re out there.

Comply with Navigation Regulations

The rules are set for everyone’s safety and convenience. Make your boating activity a fun and safe experience by paying attention to the rules.

Safety Tips for Cyclists

Do you ride your bike to work? Is it your primary means of transportation when going around town? Or do you simply use it for exercise? Regardless of your use, it is crucial to learn and understand bike safety. By knowing the precautions, you can reduce the risk of experiencing a bicycle accident and/or suffer injuries.

Admittedly bicycle safety isn’t entirely confined to the control of the cyclist. Motorists who share the road with bike riders also have the responsibility to observe proper behavior, respect, and courtesy to fellow road users, including cyclists.

All automobile drivers should be alert and be mindful for the safety of cyclists. Failure to recognize the cyclist’s rights to share the roads and traverse safely may result in injuries to the latter. A cyclist’s injuries could mean liability on the part of the driver who caused them.

So what does this mean to an everyday cyclist? As the injured party, he or she may seek compensation for damages against the erring driver.

If you or your loved one has sustained injuries in a bicycle accident, our highly experienced Las Vegas personal injury attorney can help you understand your legal options for seeking compensation.

In the meantime, the best way to ensure your safety while using your bicycle on the roads is to be alert for any potential danger. Here are simple tips to safe cycling.

Wear a Helmet

Did you know the risk of fatality in bicycle accidents in significantly reduced by wearing a helmet? So always wear one. But make sure you get a helmet that comfortably fits your head.

Choose a Bike That Matches Your Physique

Just like your helmet, pick a bike that fits you properly. So what’s the measuring stick to determine if your bike fits you?

If you’re standing over it, there should be one or two inches between you and its top bar; three or four inches if what you have is a mountain bike. When adjusting the height of the bike seat, make it so that your knee can still bend slightly while the other leg is full extended.

Check the Brakes and Tires

This is crucial especially when you’re going on a long ride or head off-roads. Always make sure the brakes work properly. You don’t want to crash onto the back of a vehicle or go straight down the intersection at a stoplight. Ensure that your bike decelerates or stops when you want it to.

Another important thing to check are the tires. Do they have the right pressure and inflation? A flat tire can be dangerous, not to mention very inconvenient.

Wear Reflective Clothing

Some drivers may have difficulty spotting bikers on the road. To catch their eye, you need brightly colored or reflective clothing, which allows them to see you easily. This safety tip is particularly applicable during nighttime rides.

Bring a Backpack for Your Stuff

Never put your stuff on one side of the handlebars. Some people tend to put their bags on one side, causing an imbalance of weight. This is potentially dangerous. Instead, put your stuff inside a backpack or in a carrier, which ensures the weight is centered and not only on one side.

Be Alert of Road Hazards

Other road hazards may include puddles and potholes, stray animals, and debris that may puncture the tires.

If you or your loved one has sustained injuries in a bicycle accident, our highly experienced Las Vegas personal injury attorney can help you. Look to Dan Lovell of Empire Law Group.

4 Safety Tips For Your Summer Travels

Summer is here! It marks the start of the season for warm, beautiful weather. And for the kids, it’s the end of classes too. There’s plenty of time for them to go outside and play. And what better way to celebrate the wonderful climate than to travel and see what the world has to offer.

Travel presents wonderful opportunities for adults and kids to enjoy the summer break. Some take the plane to their destination. Others hop on a bus or in their cars to go on a road trip. Whichever is the preference, safety should be the paramount consideration.

Check out these 4 safety tips to keep in mind when traveling to your summer destination.

1. Travel Light.

No matter where you’re going to this year’s summer vacation, it pays to travel light. You don’t need to bring a lot of things. Just the essentials and you’re good to go. The fewer the stuff you’re bringing, the less likely you’ll attract thieves or robbers.

So start by cleaning out your wallets or purses of the unnecessary stuff. If you’re traveling abroad, bring only the essential documents and a couple of IDs. Some cash would be nice but not too much though. Remember to bring only what you need and keep your pouches light.

Also, always keep your money and essential documents close to your body. Big knapsacks and large purses that hung on the side of the body can be tempting for thieves. Bulging wallets, on the other hand, can lure robbers and pickpockets. So get a purse, wallet, or bag that’s small enough not to attract these undesirable elements but big enough to contain the essentials.

Bringing a lot of stuff can make you look like a tourist. This makes you an easy target. So try to blend in. It also helps to wear basic clothing to look like a local. Leave the expensive jewelry and other accessories at home too.

2. Safety First in the Water.

Summer is almost synonymous to water. Whether it’s a pool, lake, or beach, the warm weather season is the perfect time to take a dip. As many families tend to head to the water to cool down, take the time to assess the safety conditions of the area.

Are the waves high? Is the water deep? These are just some of the important things to consider. This is especially true if you’re bringing a little kid with you.

Another matter to take into account is the crowd. Is there a risk of losing your child among the crowd? Can you easily spot him or her?

Make sure the kids are well-supervised. It’s also a good idea to let them take swimming lessons before the planned beach, lake, or pool outing. And don’t forget to put sunscreen. Sunburn can be very painful and ruin a perfectly fun vacation.

3. Safe Travels to Your Destination and Back.

Safety should always be on your mind, especially if you’re traveling with your loved ones. This consciousness should begin even before you walk out your door. So check your car, make sure you packed the things you need, get enough sleep the night before, etc.

If you plan to do a road trip, have your vehicle checked ahead of your travel. Like they say, take care of your car and your car will take care of you.

Also plan the best route. Without a plan, you might end up lost. This can be particularly dangerous. Don’t forget to pack an emergency kit like water, food, and flashlights.

4. Maintain a Buddy System.

First of all, always keep the kids close. Urge the children to do the same. If left unsupervised, they might be vulnerable to dangers. Should they get separated from the pack, set meet-up points or safe areas beforehand as a security measure.
